In-Line Skating on City Streets


In response to your verbal request to Assistant City Attorney
at
a meeting with city staff held on September 16, 1999, I have attached a draft copy of a
proposed ordinance amending Section 43-18 of the Dallas City Code to create a
defense to the current prohibition against any form of skating on city streets. The
proposed defense would allow a person to in-line skate on certain city streets if all of
the following requirements and conditions are met (you may wish to add to or
delete from these requirements and conditions):

The person must be 17 years of age or older.

The street on which the person is skating must be posted or otherwise
designated as having a speed limit not exceeding 30 miles per hour and must
not be specifically posted as prohibiting in-line skating.

The person must comply with all state laws and city ordinances applicable to
the driver of any vehicle on the city streets, except for those laws and
ordinances that, by their very nature, can have no application to in-line
skaters.

The person must travel with the direction of traffic and, when skating in
proximity to another person, must travel in single file.

The person must skate on the curb side or far right side of the right lane of the
roadway, unless: (A) an obstruction in the right lane requires a short
deviation; (B) the person is preparing to make an immediate left turn onto a
Street or property upon which skating is allowed; or (C) the person is
otherwise directed by a law enforcement officer in the performance of official
duties.

The person must use appropriate hand signals when turning left or right.

The person must yield the right-of-way to all pedestrians, bicyclists, and
motorists using or entering the street on which the person is skating.
